These terms govern your use of koyamarketing.org and any work Koya Marketing carries out for you. By using this site or engaging us, you agree to them. If a separate signed agreement or a Fiverr order exists, that document takes priority where the two conflict.
Note on Fiverr orders. Most of our projects are contracted and paid through Fiverr. Where that is the case, Fiverr's own Terms of Service govern payment, escrow, cancellation and dispute resolution, and they override anything here that conflicts with them.

We provide GoHighLevel implementation, including CRM configuration, sales funnels, websites, automation workflows, calendar and pipeline setup, integrations and related consulting. We are an independent contractor, not your employee, agent or partner.
We are not affiliated with, endorsed by, or an official reseller of HighLevel Inc. unless separately stated in writing. GoHighLevel is a trademark of its owner.
Every project begins with a written scope listing the deliverables, the timeline and the price. Work begins once you approve that scope and payment terms are met. Anything not listed in the approved scope is out of scope.
Requests that fall outside the approved scope are quoted separately. We will not carry out unscoped work and then invoice you for it.

If we are waiting on you, the delivery date moves by the same number of days. We will tell you when the clock has stopped.
A standard build is ten working days from the date we have both account access and an approved scope. Larger projects are quoted individually. Timelines are estimates made in good faith. Delays caused by third-party platforms, carrier approvals or your own response time are not our responsibility, though we will keep you informed about them.
Each project includes the number of revision rounds stated in the scope. A revision means adjusting a deliverable that was in the approved scope. Adding something new is a change of scope, not a revision.
For 14 days after handover we will correct, at no charge, anything that does not function as the approved scope specified. This does not cover new requirements, changes you make yourself, or breakages caused by third-party platform updates.
You may cancel a project at any time. Fees for work already completed are non-refundable, calculated against the proportion of the scope delivered. We may cancel and refund the undelivered portion if the project turns out to be materially different from what was described, if we cannot get the access we need, or in the event of abusive conduct.
Fiverr orders are cancelled through Fiverr's own resolution process.
Once you have paid in full, you own the deliverables built specifically for you: your funnels, pages, workflows, pipelines and copy. They live in your account and you keep them.
We keep ownership of our own pre-existing materials, including snapshots, templates, frameworks, naming conventions and internal tools, and we grant you a non-exclusive licence to use them as part of your deliverables. You may not resell or redistribute those underlying assets on their own.
Unless you ask us in writing not to, we may describe the work in our portfolio and case studies in general terms. We will not publish your customer data or anything you have marked confidential.
Each side agrees to keep the other's confidential information private and to use it only for the project. This includes your customer data, business processes, pricing and credentials. We will sign a separate NDA on request. Our obligation continues for three years after the project ends.
We warrant that we will perform the work with reasonable skill and care, and that the deliverables will function as the approved scope describes at the time of handover.
We do not warrant any particular business result. Nobody honestly can. Conversion rates, lead volume and revenue depend on your offer, your market, your pricing and your follow-through, and we do not control any of those.
To the fullest extent the law allows, our total liability for any claim connected to a project is limited to the fees you paid us for that project. We are not liable for indirect or consequential loss, including lost profits, lost data or business interruption. Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.
Our work sits on top of platforms we do not control, including GoHighLevel, Twilio, Mailgun, Stripe, Google and Meta. We are not responsible for their downtime, pricing changes, policy changes, feature removals or account suspensions. Where a platform change breaks something we built, we will quote the fix.
These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State have jurisdiction. Where a project is contracted through Fiverr, Fiverr's own dispute process applies first. Before any formal proceedings, both sides agree to attempt to resolve the matter in good faith within 30 days.
The content on this site is provided for information. You may not copy it for commercial use, scrape it, or use it to build a competing service. We may change or remove any part of the site at any time.
We may update these terms. The version in force for your project is the one published when your scope was approved. Continued use of the site means you accept the current version.
